- Charitable Giving Habits of High Wealth Individuals
Presented by Ramsay H. Slugg, J.D.
Summary: The Bank of America Study of High Net Worth Philanthropy, conducted by the Center on Philanthropy at Indiana University, is the landmark study of the charitable giving behaviors and motivations of America's wealthiest donors. This group comprises just 3% of the population, but accounts for approximately 2/3 of individual charitable giving, and 50% of all charitable giving in America. The Study explores how, why, and to whom they give. The Study has now been conducted in 3 different years, during both economic upturns and downturns, so that there now exists baseline and comparative data.
- Planning for Life After Death: Laws of Succession vs. The New Biology
Presented by Joshua S. Rubenstein, J.D.
Summary: Most of us are accustomed to having relatively broad ability to control the disposition of our property following our deaths. It comes as a surprise how little ability we have to control the disposition of ourselves, and the uses to which we can be put, following our deaths. This session will examine the ability to control burial and the disposition of body parts, the posthumous use of our genetic material, inheritance by posthumously procreated individuals, and exhumation for the purpose of genetic testing.
- Estate Planning After The Tax Relief, Unemployment Insurance Reauthorization and Job Creation Act of 2010: Big Changes, But Still No Certainty; and Current Developments on the recent Florida Supreme Court case of Olmstead v. FTC
Presented by Howard M. Zaritsky, J.D., LL.M. and Lauren Y. Detzel, J.D
Summary: The Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act of 2010 (the "2010 Act" establishes new rules governing the estates of individuals who died in 2010 and changes the landscape for estate planning going forward in 2011 and 2012. This portion of the presentation will discuss the new estate, gift and GST tax rules which apply for 2010, 2011 and 2012, the planning opportunities available under the 2010 Act, and the technical issues which remain unresolved under the 2010 Act. The presenters intend to leave ample time at the end of the presentation to respond to questions. Lauren Detzel will also discuss the planning implications arising from the recent Florida Supreme Court case of Olmstead v. FTC , which held that assets owned in a single-member LLC are not protected from the creditors of the individual member, and provide an update on various efforts for a legislative solution in response to Olmstead.
- The Buy-Sell Agreement: The Closely-Held Business' Most Important Legal Document

Summary: This outline considers the key tax and nontax issues that must be addressed in planning to use a buy-sell agreement: (1) Where should one document the restrictions? (2) What types of transfers should be restricted? (3) How can one best assure favorable income tax treatment? (4) How best to fund the buy-out? (5) What are the estate, gift, and GST tax ramifications? (6) How should the agreement restrict competition by former owners? (7) How should the agreement change control from a strict one-share, one-vote regimen? (8) What special transactions should be covered in the agreement? (9) When is a covered opinion required by Circular 230? This outline is approximately 300 pages, and includes several forms.
